ENTRY IN THE SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.
1. Eligibility: You must be a legal resident of the Eligibility Area and of the age of majority in your province/territory of residence at the time of your entry. Void where prohibited by law. Employees and agents of Yahoo! Canada Co. (“Sponsor”), Inventa Sales and Promotions Inc., and Addrenaline Media Inc., each of their respective affiliates, advertising and promotional agencies, any other prize sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Sponsor, collectively referred to as the “Promotion Entities”), and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win.
2. How To Enter: The Sweepstakes begins at 12:01 am EST on October 22, 2007 and ends at 11:59 pm EST on December 2, 2007 (the “Sweepstakes Period”). For purposes of this Sweepstakes, the 24 hours between 12:00:00 AM EST and 11:59:59 PM EST constitute a “Day”. You may enter the Sweepstakes during the Sweepstakes Period as follows:
To enter, please submit your full name and email address above. Also, please check the appropriate box to accept these Official Rules in order to considered a potential winner if your entry is selected. Limit of one entry per person per Day during the Sweepstakes Period.
The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the methods described above. Proof of sending (such as an automated computer receipt confirming delivery of email or "thanks for entering" message etc.) does not constitute proof of actual receipt by the Promotion Entities of an entry for purposes of these Official Rules. Automated entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Only eligible entries actually received by the Promotion Entities during the Sweepstakes Period will be included in the prize drawing. Illegible, unintelligible, incomplete, garbled, or mutilated entries will be disqualified. All entries become the property of the Sponsor, and none will be acknowledged or returned.
3. Conduct: By entering the Sweepstakes, entrants agree to comply with and be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes website www.beabettercontest.com throughout the Sweepstakes Period. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by the decisions of the judges, which will be final and binding in all respects. The Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor’s website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
4. Prizes:
Total approximate aggregate prize value during the Sweepstakes totals CDN $9,600. Prizes to be awarded in each week of the 6 weeks during the Sweepstakes Period will be broken down as follows:
1. Three CDN $50 prizes
2. Two CDN $100 prizes
3. One CDN $250 prize
4. One CDN $1,000 prize
The following applies to each of the above prizes: Prizes may not be used in conjunction with any other promotion or offer and may not be separated. All cash prize values will be awarded via cheque.
Prizes must be accepted as awarded, without substitution, and are not assignable, transferable or convertible to cash and are not for resale. The Sponsor may assign its rights and obligations respecting this Sweepstakes (including under these rules and regulations) at any time. The Sponsor reserves the right in the event that the advertised prize (or any component thereof) cannot be awarded as described for any reason, to substitute another prize (or any component thereof) with another prize of equal or greater value without liability. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize, are the sole responsibility of the winner of that prize. To the extent permitted by applicable law, the Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the Sweepstakes or the delivery and/or subsequent use of the prizes awarded. The Sponsor makes no representations or warranties concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. The Promotion Entities will not replace any lost or stolen prize items.
5. Winner Selection and Notification:
PRIZE DRAWING: Random draws will be held each Day during the Sweepstakes Period at 9:00:00am EST to select the Selected Entrants from among all eligible Online Entries received during the previous Day of the Sweepstakes Period.
The first entry drawn on any given Day of the Sweepstakes Period will be the “Selected Entrant” for the prize to be awarded on that Day of the Sweepstakes Period. Subject to meeting the requirements set out herein and being deemed a “Winner” by the Sponsor, the Selected Entrant will receive a prize in one of the four denominations for prizes set out above. In each week of the 6 weeks of the Sweepstakes Period, the determination as to which of the four possible denominations to be awarded on any given Day of the week is selected at random.
The following applies to each of the prize drawings: Odds of winning a prize on any given Day of the Sweepstakes Period depend on the number of eligible entries received during the previous Day of the Sweepstakes Period and on the number and denomination of the prizes that remain available to be won in the applicable week of the Sweepstakes Period. Each prize drawing will be conducted by an independent judging organization whose decisions are final.
The Selected Entrants will be notified within 48 hours after the applicable “Draw” via email. Before being declared a winner, each Selected Entrant must sign a declaration and release form which releases the Promotion Entities and each of their respective shareholders, directors, officers, employees and assigns (the “Release Form”) and must correctly answer, without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing question posed on the Release Form. The Release Form must be returned within the time period specified on the Release Form or the prize may be forfeited. The Sponsor will contact each confirmed winner within 3 Days of receipt of the duly completed Release Form to arrange for delivery of the relevant prize to the confirmed winner. Winners must also provide any additional information that may be required by the Promotion Entities, except where prohibited by law. Return of any prize/prize notification as undeliverable, or the inability of the Promotion Entities to contact a Selected Entrant may result in disqualification and selection of an alternate Selected Entrant by random drawing from the remaining eligible entries received for the particular draw.
In the event that: (a) a Selected Entrant cannot be reached within 48 hours of the Draw; (b) the Selected Entrant’s answer to the mathematical skill-testing question is incorrect; and/or (c) a Selected Entrant does not complete the Release Form and return same within the time period specified on the Release Form, the prize will be forfeited and an alternate Selected Entrant will be randomly drawn from the remaining eligible entries received.
6. General Conditions: The Sweepstakes is governed by the laws of the province of Ontario and the federal laws of Canada applicable in that province.
By entering, each entrant: (a) releases and holds harmless the Promotion Entities, and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for or participating in any prize-related activity, and (b) grants to the Sponsor the right to use and publish his/her name and province of residence online and in print, or via any other media, in connection with the Sweepstakes.
Except where prohibited by law, a winner’s acceptance of a prize constitutes permission for the Promotion Entities to use such winner’s name, address (city and province only), statements, photograph, voice and/or likeness for any advertising and promotional purposes relating to the Sweepstakes without further compensation, consideration, review or consent.
7. Limitations of Liability: The Promotion Entities assume no responsibility for lost, late, misdirected, illegible, or mutilated entries, or for theft, destruction or unauthorized access to, or alteration of, entries. The Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes. The Promotion Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing. The Promotion Entities are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Promotion Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners from among all eligible entries received prior to the cancellation. This process will be repeated until a winner has been confirmed for each prize.
